Access to this website is granted strictly in accordance with these Terms and Conditions.  These Terms and Conditions apply also to all orders/delivery requests placed by you through this website or in a branch.

These terms tell you who we are, how we will provide the grocery service to you, how you and we may change or end the contract, what to do if there is a problem and other important information. 

Please read these Terms and Conditions carefully and print and keep a copy of them for your reference.

We may change our Terms and Conditions at any time, so please do not assume that the same terms will apply to future orders/delivery requests. We reserve the right to:

• Modify or withdraw, temporarily or permanently, this website (or any part thereof) with or without notice to you and you confirm that we shall not be liable to you or any third party for any modification to or withdrawal of the website; or

• Change the Terms and Conditions from time to time. 

You will be deemed to have accepted such changes if you continue to use this website (or any part of it) or you continue to place orders/delivery requests after any such changes. 

It is your responsibility to check regularly to determine whether the Terms and Conditions have been changed. If you do not agree to any change of the Terms and Conditions then you must immediately stop using this website.

To the fullest extent permitted by applicable laws, TFConline hereby excludes liability for any claims, losses, demands, or damages of any kind whatsoever with respect to the website or the Materials including, without limitation, direct, indirect, incidental, or consequential losses, or damages, whether arising from loss of profits, loss of revenue, loss of data, loss of use or otherwise and whether or not the possibility of such loss has been notified to TFConline. The foregoing will apply whether such claims, loss or damages arise in tort, contract, negligence, under statute or otherwise. 

The service is provided as is and on an as-available basis. We give no warranty that the service will be free of defects or faults.

However, if you are a consumer your statutory rights are not affected.

Nothing in these Terms and Conditions will reduce your statutory rights relating to faulty or mis-described products. 

Restricted Items

To comply with licensing and other legislation some products and services on this website are only available to certain categories of customers (such as people aged 18 years and over) ("Restricted Items").  The types of items that fall into the category of Restricted Items include alcohol. We will not be selling any alcoholic drink to anyone who is not 18 years old or over.

By placing an order you confirm that you are at least 18 years old.

   

ACCOUNTS

In order to purchase goods on this website and to use the similar facilities, you are required to create an account which will contain certain personal details and payment information which may vary based upon your use of the website and we may not require payment information until you wish to make a purchase. By registering an account for this service you represent and warrant that:

All information you submit is accurate and truthful;

You have permission to submit payment information where permission may be required, and

You will keep this information accurate and up-to-date.

Your email address is essential in order for us to be able to supply you with important information such as order confirmations, and changes to the service. By registering with TFC Online, you accept that your email address may be used to supply you with such information. 

It is recommended that you do not share your account details. TFC Online accepts no liability for any losses or damages incurred as a result of your account details shared by you.

Delivery/collection restrictions

Delivery is available in restricted areas. Delivery will be made to the address specified by the customer when completing the online order form. The costs of delivery will be as displayed to you on our website. 

TFC online will notify you by way of email when your goods are to be dispatched to you, corresponding with the convenient delivery slot you have chosen at the checkout. The email will contain details of estimated delivery times in addition to any reasons for a delay in the delivery of the goods purchased by you. Please note that delivery and collection times are subject to availability.

 We reserve the right not to deliver to all locations and we will tell you when you apply to register an account with us whether we can deliver to your address.

 You are responsible for making suitable arrangements to receive your delivery and giving us appropriate instructions. In the event that your delivery is stolen from your doorstep or damaged while there, we do not accept liability, and will offer compensation at our discretion. We reserve the right to refuse to accept orders from any customer; considerations of delivery problems may give rise to such a refusal. 

 We endeavour to keep your delivery day the same, but we reserve the right to change it temporarily or permanently and will tell you if we do so. 

TFC Online shall use their reasonable endeavours to meet any date agreed for delivery. You have legal rights if we deliver any goods late. If we miss the delivery deadline for any goods then you may treat the contract at an end immediately if any of the following apply:

      (a) we have refused to deliver the goods;

      (b) delivery within the delivery deadline was essential (taking into account all the relevant circumstances); 

      or

      (c) you told us before we accepted your order that delivery within the delivery deadline was essential.

If you do choose to treat the contract as at an end for late delivery, you can cancel your order for any of the goods or reject goods that have been delivered.

If there is no one to receive the grocery delivery at the specified address at the time of your scheduled delivery, we reserve the right to return your order to our store and to charge a delivery charge for re-delivery.

If TFC Online receives no communication from you, within 24 hours of delivery, regarding any problems with the goods, you are deemed to have accepted and received the goods.

Non-acceptance of an order may be a result of one of the following:

• The product you ordered is not available from stock.

• We are unable to obtain authorisation for your payment.

• A price or product description error is identified.  

• You do not meet the eligibility to order criteria set out in the main Terms and Conditions.

The contract or any order will be concluded in English. If you do require any information regarding orders you have placed with TFConline please write to the TFConline Customer Care Team, the address details of which are set out in this section above.       

Cancellation and Returns

You are also entitled under consumer laws in the United Kingdom to cancel your order if you are contracting with us online or by phone and, should you wish to do so.We guarantee the quality of our goods. Returns are governed by these Terms and Conditions. 

You must inspect the goods and notify us promptly of any dissatisfaction with your order. We will promptly and fully refund the cost of any goods that do not meet with your reasonable satisfaction. If you receive goods which do not match what you ordered , unless accompanied by an explanatory note detailing the changes, stating reasons for the changes and setting out your options, you should notify us within 24 hours to arrange collection and return.

 TFConline is not responsible for paying shipment costs for postal deliveries. You will be given the option to have the goods replaced with those ordered (if available) or to be refunded through the payment method used by you when purchasing the goods. Refunds and replacements will be issued upon our receipt of the returned goods. 

Products should be returned in their original packaging along with the original price tags, labels and invoices.

It is advised that the return packets should be strongly and adequately packaged so that there is no further damage of goods in transit.

If any perishable goods (vegetables and fruits)you have purchased have faults when they are delivered to you, you should contact within 12 hours to arrange collection and return. Goods must be returned in their original condition with all packaging. Upon receipt of the returned goods, the price of the goods, as paid by you, will be refunded to you through the payment method used by you when purchasing the goods.

If goods are damaged in transit and the damage is apparent on delivery, you should sign the delivery note to the effect that the goods have been damaged. In any event, you should report such damage to TFC online within 24hours and arrange collection and return. Upon receipt of the returned goods, the price of the goods, as paid by you, will be refunded to you.

 If the goods have been dispatched or delivered, but you have changed your mind, please give written notice of your wish to return the goods to TFC Online within 14 working days of receipt. You will not be entitled to this cancellation period should the item be considered to be something that deteriorates quickly, has a limited expiration date or is frozen food. These non-refundable goods are defined under the term “perishable food and drink.” 

For health and hygiene reasons the following items sealed for protection reasons will be deemed as used if unwrapped: Personal grooming products e.g. hair accessories and styling products, shavers, waxing kits, electric toothbrushes etc, and will therefore be unable to be returned if not in their original unused condition. 

Cancellation will be accepted only upon customers’ written consent. We would request you to send the products back to our warehouse as soon as you can after the cancellation. The consumer has a duty of care for the products during the cancellation period. You are responsible for paying shipment costs if goods are returned for this reason.

Credit Card safety when shopping online

The TFConline food shopping service uses Secure Sockets Layer (SSL) technology to encrypt your details as they are being transmitted to us.  This technology is designed to minimise the risk that someone else could breach your privacy when shopping online 

General Pricing Policy

All the pricing information on the website is correct at the time of going online, however prices at the time of ordering are guide prices. TFC online reserves the right to change prices and alter or remove any special offers from time to time and as necessary. 

Prices and the availability of special offers may vary for future dated deliveries and collections.

Where Multi-value offers to apply to a set of differently priced items, the saving or free item applies to the cheapest item or items.

Weighed items such as fruit may vary in weight from that ordered.Some of our Products are priced by weight (for example, vegetable and fruits ).We show the prices for weights on the Website. The average weight and price shown is for guidance only; the weight you receive may vary from this guide and the price you are charged will be for the weight of Product delivered. If the weight of the Product exceeds the guide weight by more than 20%, the price you are charged will not exceed 20% in addition to the average.

Where an item is unavailable and you have indicated that you will accept substitutions, an alternative will be supplied that may affect the price that you pay. If we substitute an item with a more expensive one, you’ll only pay the lower of the two prices

The prices stated on the site are inclusive of any VAT

Nothing in these Terms and Conditions will reduce your statutory rights relating to faulty or mis-described products. For further information about your statutory rights contact your local authority, Trading Standards Department or Citizens Advice bureau.

PRIVACY POLICY 

Your privacy is of the highest importance to us, and we promise never to release your personal details to any outside company for their mailing or marketing purposes. We will treat all your personal information as confidential (although we reserve the right to disclose this information in the circumstances set out below). We will keep your details on a secure server and we will fully comply with all applicable UK Data Protection and consumer legislation in place from time to time.
